Being accused of Driving While Under the Influence of Alcohol (or Drugs) is a very serious matter. If you are convicted of Driving While Under the Influence (DUI) your Illinois Driver's License will be revoked - even if you are a first offender. You also will have to contend with the suspension of your Illinois Driver's License whether you chose to take the breathalyzer or not. This is known in Illinois as the Statutory Summary Suspension.

The first action I usually take is to file a petition to rescind the statutory summary suspension. The purpose of filing this petition is simply to try and knock out the suspension you received for either refusing to take the breathalyzer or for taking the breathalyzer and blowing over .08.

After I receive copies of the police reports, breathalyzer results, etc. I will evaluate your case. I will give you my honest legal opinion about the strength of the prosecution's case. I will also inform you of potential weaknesses in their case.

  • The prosecution was unable to prove the motorist was intoxicated
  • The prosecution was unable to prove the motorist was driving
  • The arresting officer did not have probable cause to arrest the motorist
  • The results of the breathalyser test were suppressed
  • The arresting officer was not authorized to administer the breathalyser test
  • The arresting officer did not properly administer the Field Sobriety Tests
  • The videotape of the arrest obtained by my office proved the arresting officer was not being truthful about the circumstances of the arrest
